Terms of Service & Privacy Policy for Refresh My Car LLC

Terms of Service

Introduction

  1. This document constitutes a binding agreement between Refresh My Car LLC (hereinafter referred to as “Company”) and the customer (hereinafter referred to as “Client”) with respect to the services provided by the Company.

Services

  1. The Company provides on-site detailing services for automobiles, including but not limited to washing, waxing, vacuuming, and interior cleaning. The scope of work will be determined by the Client and the Company and will be specified in a separate agreement.

Fees

  1. The Company reserves the right to charge additional fees that are not displayed at the booking checkout page or reflected in the price shown in the Booking Checkout, Booking Form, or E-mail sent to the Client with a booking request summary. These fees may include, but are not limited to, an Extra Dirty Fee ($10-$50), a Pet Hair Removal Fee ($15-$50), and an Excessive Trash Removal Fee ($10). These fees may be stacked, meaning the Client may be charged for multiple fees for a single service. The Company will provide the Client with a clear explanation of any additional fees charged and the reason for the fee.

 

Payment

  1. Payment is due before or after The Client’s service is completed, and it is at The Company's discretion to determine when payment will be due. We accept cash, credit cards, and debit cards as forms of payment. In the event of cancellation, The Company reserves the right to charge a cancellation fee. 

Refunds and Satisfaction Guarantee

  1. If for any reason The Client is unsatisfied with The Company’s services, please let us know, and we will do everything in our power to make it right. However, if The Company believes the service was performed correctly to The Company’s standards, then The Company reserves the right to charge the full price for the service provided. The Company does not offer refunds for services rendered.

 

Responsibility for Vehicle

  1. The Client shall be responsible for the safety and security of their vehicle during the detailing process. The Company shall not be responsible for any damage to the vehicle or its contents except in cases of gross negligence or intentional misconduct on the part of the Company.

Scheduling

  1. The Client shall schedule the services with the Company at least 3 hours in advance and the request for booking must be submitted at least 3 hours prior to the requested time. The Client may submit a booking request by pressing the "Book Now" button on the Company's website or through any other means provided by the Company. However, submission of the booking request does not guarantee the booking will be approved. The Company reserves the right to approve or deny a booking request based on availability, scheduling conflicts, or other circumstances. The Company also reserves the right to reschedule or cancel services in the event of inclement weather or other circumstances beyond its control.

Right to Refuse Service

  1. The Company reserves the right to refuse service to any Client for any reason, including but not limited to: (i) disrespectful or inappropriate behavior, (ii) suspicion of theft or damage to previous vehicles, (iii) a vehicle that is in unsanitary condition, (iv) a vehicle that poses a safety risk to the Company’s employees.

Warranty

  1. The Company does not offer any warranties for services.

Limitation of Liability

  1. The Company shall not be liable for any indirect, incidental, special, or consequential damages arising from the services provided. The Company’s liability to the Client shall not exceed the total amount paid for the services.

Governing Law

  1. This agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which the services are provided.

Entire Agreement

  1. This agreement constitutes the entire agreement between the parties and supersedes all prior understandings and agreements, whether written or oral. No amendment or modification of this agreement shall be binding unless in writing and signed by both parties.

By using the services provided by the Company, the Client agrees to be bound by these terms and conditions.

Privacy Policy

At Refresh My Car LLC, accessible from www.Refreshmycar.com, one of our main priorities is the privacy of our visitors. This Privacy Policy document contains types of information that is collected and recorded by Refresh My Car LLC and how we use it.

Log Files

Refresh My Car LLC follows a standard procedure of using log files. These files log visitors when they visit websites. All hosting companies do this and a part of hosting services’ analytics. The information collected by log files include internet protocol (IP) addresses, browser type, Internet Service Provider (ISP), date and time stamp, referring/exit pages, and possibly the number of clicks. These are not linked to any information that is personally identifiable. The purpose of the information is for analyzing trends, administering the site, tracking users’ movement on the website, and gathering demographic information.

SMS/Text Messaging Consent and Opt-In

By placing an order, a booking request, creating an account, or providing your phone number to Refresh My Car LLC in any capacity, you are giving your explicit consent to receive SMS or text messages from us. This includes, but is not limited to, order confirmations, updates related to your account, and customer service communications. Please note that message and data rates may apply depending on your mobile carrier and plan.

 

Explicit Marketing Consent:

Beyond our standard communications, we offer marketing messages containing special offers, news, and other promotional material. We require a distinct and separate opt-in for these marketing messages. You’ll have the opportunity to provide consent for these communications during the account creation process or at any other interaction point where phone numbers are collected. Additionally, you can change your preferences anytime through your account settings.

 

Opt-Out:

If you wish to cease receiving SMS/text messages from us, whether general communications or marketing messages, you have two ways to opt-out:

  1. Follow the opt-out instructions provided within each received message.

  2. Email us at hitrefreshdfw@gmail.com with a clear request to be removed from our SMS communication list.

Opting out of these communications will not hinder your ability to use any features of our services or receive crucial updates related to your account.

 

Third-party Sharing:

Your trust is paramount to us. Refresh My Car LLC does not, under any circumstances, share your SMS opt-in data or related personal data with third-party advertisers or any external organizations. We strictly use the collected data for internal purposes, aiming to enrich your experience with our services.

Cookies and Web Beacons

Like any other website, Refresh My Car LLC uses ‘cookies’. These cookies are used to store information including visitors’ preferences, and the pages on the website that the visitor accessed or visited. If you think that your child provided this kind of information on our website, we strongly encourage you to contact us immediately and we will do our best efforts to promptly remove such information from our records.
